Aloha Ads LLC, a Wyoming limited liability company with its address at 1309 Coffeen Ave, STE 1200, Sheridan, WY 82801, USA ("Aloha Ads", "we", "our" or "Company"), welcomes you, a visitor of our website at aloha-ads.com (the "Website" or "Site"), and the third-party advertisers and demand partners ("Advertisers") and third-party publishers ("Publishers") using our services as detailed below.
Aloha Ads operates a programmatic advertising platform that enables Advertisers to display advertisements and marketing materials to end users who use or otherwise interact with mobile apps, connected-TV (CTV) apps and websites ("Digital Assets") owned or operated by our Publishers (collectively, the "Services").
For the purposes of this privacy policy ("Privacy Policy"), a "User" refers to a visitor of the Site, an Advertiser or a Publisher, as well as their applicable end users.
Below we explain which data we collect and how we process and use it. We process personal data on the following bases:
We may collect two types of data and information from our Users. The first type is non-identifiable and anonymous information ("Non-Personal Information"). We are not aware of the identity of the User from which we have collected the Non-Personal Information. Non-Personal Information consists of technical and behavioral information and may include, among other things, the activity of the User on the Services, the type of operating system, browser and device, the app or website in which an ad is requested, the User's connection to the Site, and approximate geo-location.
The second type is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual ("Personal Information"). Personal Information includes: (i) contact information such as your name and email address, which you have submitted voluntarily; and (ii) Internet Protocol ("IP") addresses and device advertising identifiers, such as IDFA, Google Advertising ID and CTV advertising identifiers (collectively, "Identifiers"). While Identifiers are considered Personal Information in many jurisdictions (such as the EEA and the UK), in some jurisdictions they are not. We treat such information as Personal Information in accordance with applicable laws, but we do not attempt to analyze or determine your identity based on it, and we do not combine it with any Personal Information such as your name or email address.
For the avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information is deemed Personal Information for as long as that connection or linkage exists.
You are not required by law to provide us with any information. You can always avoid providing us certain Personal Information; however, this may prevent you from using certain Services.
Depending on the nature of your interaction with the Services, we may collect information as follows:
(i) Through ad requests: when a Publisher's Digital Asset sends an ad request to our platform, we receive technical information such as the IP address, device type, operating system, advertising identifier, app or site identifier, approximate location and any privacy or consent signals included in the request.
(ii) Automatically: we may use cookies or similar technologies (as described in the "Use of cookies" section below) to gather some information automatically.
(iii) Provided by you voluntarily: we collect information if and when you choose to provide it to us, for example through an agreement, an insertion order or when you contact us.
Aloha Ads will not share any Personal Information it collects with any third party, except in the following cases: (i) Compelled disclosures. To satisfy any applicable law, regulation, legal process, subpoena or governmental request; (ii) Enforcement of our rights. To enforce this Privacy Policy and/or our agreements, including investigation of potential violations; (iii) Fraud detection. To detect, prevent or otherwise address fraud, invalid traffic, security or technical issues; (iv) Business transfers. If Aloha Ads undergoes a change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (v) Service providers. To collect, hold and/or manage Personal Information through Aloha Ads' authorized third-party service providers, as reasonable for business purposes; (vi) Explicit consent. With your explicit approval prior to the disclosure; or (vii) Advertising transactions. To operate our business and provide the Services, we share the information contained in ad requests, including Identifiers, with Advertisers and demand partners so they can bid on and deliver advertisements, and we use it to calculate payments in connection with the Services.
Publishers are responsible for providing any notices and obtaining any consents required by applicable law from their end users, and for including the resulting privacy signals (such as IAB TCF or Global Privacy Platform strings) in their ad requests.
For the avoidance of doubt, Aloha Ads may transfer, disclose or otherwise use Non-Personal Information, information linked to anonymous random identifiers, or information aggregated in a non-identifiable way, at its own discretion.
We retain the information we collect for as long as it remains necessary for the purposes set out above, in accordance with applicable laws, or until an individual expresses a preference to opt out. We may, at our sole discretion, delete or amend information from our systems without notice once we deem it no longer necessary for such purposes.
Individuals have the right to know what information we hold about them and, in some cases, to have that information communicated to them. Individuals may also ask us to confirm whether or not we process their Personal Information. Subject to the limitations in applicable law, individuals may also be entitled to obtain from us the Personal Information they have provided to us in a structured, commonly used and machine-readable format, and may have the right to transmit it to another party.
The principal rights under applicable data protection law in relation to Personal Information are: the right of access; the right to rectification; the right to erasure; the right to restrict processing; the right to object to processing; the right to data portability; the right to complain to a supervisory authority; and the right to withdraw consent (to the extent applicable).
Where we are not able to provide you with the information you have asked for, we will endeavor to explain why and inform you of your rights, including the right to complain to a supervisory authority. We may ask for reasonable evidence to verify your identity before we provide any such information, in accordance with applicable law. Locating and deleting data may take up to one (1) month after we receive the verification we require. Data privacy laws in your jurisdiction may give you different or additional rights, which may also apply.
We use third-party software and services to operate the Site and the Services, including to collect and/or process the information described in this Privacy Policy ("Third-Party Service Providers"). These are independent providers, and Aloha Ads is not responsible for their information collection policies. Our Site does not use advertising or analytics cookies. Our hosting provider may set strictly necessary cookies to protect the Site against abuse. Cookies and similar technologies store certain information on your device and can enable certain features. Most browsers allow you to erase cookies, block them, or receive a warning before a cookie is stored. If you block or erase cookies, your experience of some websites may be limited.

We take great care in implementing and maintaining the security of the Site, the Services and your information. We employ industry-standard procedures and policies to keep our Users' information safe and prevent unauthorized use, including technical, physical and administrative security measures such as industry-standard encryption (SSL/TLS) and limiting access to information on our systems. We store data with reputable cloud infrastructure providers that maintain industry-standard security.
Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access to or abuse the Services, and we make no warranty, express, implied or otherwise, that we will prevent such access.
The Aloha Ads Services are not directed to children, and we do not knowingly collect information from children. If you have any information regarding the use of the Services by a minor under the age of eighteen (18), please let us know at info@aloha-ads.com. You must be at least eighteen (18) years of age to use the Aloha Ads Services. By using the Aloha Ads Services, you represent and warrant to us that (i) you are at least eighteen (18) years of age; (ii) you have not previously been suspended or removed from the Aloha Ads Services; and (iii) your use of the Aloha Ads Services complies with all applicable laws and regulations.
This Privacy Policy governs the use of the Aloha Ads Services and any information collected through them. Aloha Ads reserves the right to change this policy at any time, so please revisit this page frequently. In the event of any substantial change, we will make reasonable efforts to post a clear notice on the Site. Substantial changes take effect seven (7) days after such notice is provided on the Site or sent by email. All other changes are effective as of the stated "Last Revised" date, and your continued use of the Aloha Ads Services after that date constitutes acceptance of those changes.
We may store or process your Personal Information in the United States or in other countries. If you visit our Site or use our Services from outside the United States, information you provide may be transferred to and processed in countries other than the one from which you accessed the Site or Services, including the United States. If you are a resident of the European Economic Area ("EEA") or the United Kingdom, we will take appropriate measures to ensure that your personal data receives an adequate level of protection when transferred outside the EEA or the UK.
If you are a resident of a jurisdiction where the transfer of your personal data requires your consent, your consent to this Privacy Policy includes your express consent to such transfer.

By contacting Aloha Ads, you warrant that you are free to do so and that you are not providing Aloha Ads with information that violates any third party's intellectual property rights ("Information"). Without limiting the foregoing, all rights, including intellectual property, arising from the communication will be owned by Aloha Ads and will be considered Aloha Ads' confidential material. Any use of the Information will be at Aloha Ads' sole discretion, and Aloha Ads is not obligated to use all or part of it.
